By accessing or using the services provided by Seva Healthcare (“Seva,” “we,” “us,” or “our”), including but not limited to our websites, patient portals, messaging systems, or any other online or electronic communication platforms (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”) and our Notice of Privacy Practices. If you do not agree to these Terms, you may not use our Services.

Seva Healthcare operates medical clinics in Texas and Oklahoma, providing health and wellness services (“Clinical Services”) and related communications such as appointment reminders, follow-up surveys, and promotional offers (“Communications Services”). These Terms govern the use of both Clinical and Communications Services offered by Seva.

4. Use of Services

You agree to use our Services only for lawful purposes and in accordance with these Terms. You will not use our Services in any manner that could interfere with their operation, violate applicable law, or infringe upon the rights of others

5. Messaging and Communication Consent (A2P Compliance)

By providing your mobile number and selecting the consent checkbox during registration or through any of our intake forms, you expressly consent to receive text messages, calls, and other communications from Seva Healthcare and its affiliates, including appointment reminders, health-related information, promotional messages, and patient satisfaction surveys.

These messages may be sent using automated dialing technology and may constitute “A2P” (Application-to-Person) messaging as defined by the Cellular Telecommunications Industry Association (CTIA). Message and data rates may apply depending on your carrier and plan.

You understand that providing consent is not a condition of receiving medical care or services from Seva Healthcare.

6. Opt-Out and Message Frequency

You may opt out of receiving text messages at any time by replying STOP to any message you receive. After opting out, you may receive a final confirmation message acknowledging your request.

You may also contact us directly to update your communication preferences.
Message frequency will vary depending on your interactions with us but generally includes:

  • Appointment reminders and confirmations;

  • Occasional promotional offers related to wellness services; and

  • Limited follow-up surveys following visits.

7. Data Privacy and Security

Your personal and health information is handled in accordance with Seva Healthcare’s Notice of Privacy Practices, which describes how we collect, use, and protect your information under the Health Insurance Portability and Accountability Act (“HIPAA”).

By using our Services, you acknowledge that electronic communications (including SMS and email) may carry some security risks, and you accept those risks when choosing to communicate with us electronically.

8. Disclaimers and Limitation of Liability

The Services, including all information provided through electronic communications, are offered on an “as is” and “as available” basis. Seva Healthcare makes no warranties, express or implied, regarding the accuracy, completeness, reliability, or suitability of any information provided through the Services.

To the fullest extent permitted by law, Seva Healthcare and its affiliates, officers, employees, and agents are not liable for any damages, losses, or claims arising from your use of the Services, including but not limited to data breaches, unauthorized access, or errors in transmission.

9. Intellectual Property

All content, logos, designs, trademarks, and other materials available through the Services are the property of Seva Healthcare or its licensors and are protected by intellectual property laws. You may not reproduce, modify, distribute, or create derivative works without prior written permission from Seva Healthcare.

10. Indemnification

You agree to indemnify, defend, and hold harmless Seva Healthcare and its affiliates, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of your use of the Services or violation of these Terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict-of-law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Tulsa County, Oklahoma.

12. Amendments

Seva Healthcare reserves the right to modify or update these Terms at any time without prior notice. The updated version will be posted on our website with the revised effective date. Continued use of the Services constitutes acceptance of any such changes.
